As your client’s attorney you work diligently to help your clients through a difficult divorce process. Let me help you create better settlement agreements for your clients, which explore all aspects of the sales process (during the divorce process) so that we can reduce client stress and turmoil, better prepare our clients to sell their home, and maximize the chances for your clients’ home sale success.

Bridging the Gap Between Legal Representation and Real Estate Success

Attorneys negotiate agreements between clients to sell the home, but we generally don’t give them the tools they need to maximize the sale price of their home; further, we often don’t support them through the sale of the home. As a family law attorney, I understand that negotiating the details of the sale of the home can feel like an inefficient use of lawyer (or team) time, but as a realtor I know that our clients often still need the support of the Collaborative Law process, and a trained team member to sell what is often the largest asset in our client’s portfolio. Finally, when settlement agreements require future sale of the home, we want to make sure those agreements will be honored.

During the Collaborative Law case my team will:

  • Tour the home, and evaluate the overall suitability for sale
  • Run title, and alert attorneys to any issues on title
  • Help the client obtain a pre-inspection of the home
  • Prepare a Comparative Market Analysis (though we recommend appraisals for valuation purposes and do not provide this analysis for the purpose of home valuation)
  • Help clients understand what can be done to the home in order to maximize the sale price, and the cost of upgrades and improvements
  • Help the client(s) understand home sale process, preparation costs, sales costs and facilitate any agreements for work that will be done
  • Report our findings to the team attorneys
  • Provide for the team attorneys to document any agreements regarding the sale of their home in their Separation Contracts

We don’t:

  • We don’t facilitate discussions of the value of the home (for divorce purposes)
  • We don’t facilitate discussions regarding when the house will be sold, other than providing generally accepted real estate advice
  • We don’t facilitate discussions as to who will occupy the home

Our work will typically be done outside of the team meetings and we will only alert the attorneys to problems or disagreements that need to be resolved by the team

We understand that the sale of the home may not occur for a period of years; however, your clients will likely still need support to meet their signed agreements when home-sale deadlines approach.
